By accessing or using ProgramRX ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, then you may not access the Service.

"Service" refers to the ProgramRX website and application
"User" refers to any individual using the Service
"Coach" refers to users with a paid coaching subscription
"Athlete" refers to users connected to Coaches
"Content" refers to workouts, training programs, notes, and other materials created by Users

3. Account Registration

To use certain features of the Service, you must register for an account. You agree to:

Provide accurate, current, and complete information
Maintain and promptly update your account information
Maintain the security of your password
Accept responsibility for all activities under your account
Immediately notify us of any unauthorized use

4. Age Requirements

The Service is available to users who are:

18 years of age or older, OR
13 years of age or older with verifiable parental consent

By using the Service, you represent that you meet these age requirements.

5. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose
Impersonate any person or entity
Interfere with or disrupt the Service
Attempt to gain unauthorized access to any portion of the Service
Upload viruses or malicious code
Collect or store personal data about other users
Use the Service to send spam or unsolicited messages

6. Content Ownership and Rights

Your Content: You retain ownership of all Content you create. By using the Service, you grant ProgramRX a limited license to store and display your Content solely for the purpose of providing the Service to you.

Coach Content: Coaches retain ownership of all workouts, programs, and coaching materials they create.

Athlete Content: Athletes retain ownership of their workout results, notes, and personal data.

7. Pricing and Payment

Athletes: The Service is free for Athletes.

Coaches: After a 30-day free trial, Coaches must subscribe at $49.99/month to continue using the Service. Payment processing is handled by Stripe.

Prices are subject to change with 30 days notice. You may cancel your subscription at any time.

8. Privacy

Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy, which also governs the Service and informs users of our data collection practices.

9. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will cease immediately. You may delete your account at any time through your account settings.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

ProgramRX is not responsible for any injuries that may result from participating in activities or exercises suggested by the Service. Always consult with a qualified healthcare provider before beginning any fitness program.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROGRAMRX SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SERVICE.

12. Governing Law

These Terms shall be governed by the laws of the State of Texas, United States, without regard to its conflict of law provisions.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page and updating the "Last updated" date.
